Legalization of documents in US for marriage registration in Vietnam

Legalization of documents in US by non-Vietnamese citizen for marriage registration in Vietnam is made in three steps:

Step 1: Completion of file of required documents in US for marriage registration in Vietnam 

1. Application for Marriage Registration in Viet Nam (in standard form): your photo, provide your information, sign your name. Leave blank the column of the other applicant in Vietnam.
2. Affidavit of Single Status
3. Certificate of No-Marriage Records issued by State or County Authorities (Vital Statistics Office, Department of Health, State Registrar ...) within the last six months, certifying that no marriage license or marriage record of the applicant has been found from his/her mature age of marriage (age of 18 for female and 20 for male) or since his/her divorce up to the present or since his/her spouse’ death up to present.
4. Certificate of Good Mental Health issued by an authorized medical institution, confirming that the applicant has no mental illnesses, or mentally sound for marriage, and is fully conscious of his/her own actions.
5. Biographic Information Sheet
6. Photocopy of the photo and signature pages of the Passport
7. Power of Attorney for submission of application (if any):
The non-Vietnamese party can, with a Power of Attorney, entrust his/her fiancé(e) to submit the application package in Vietnam.
7. Other documents in addition to the 6 above-listed documents (if any):
- Divorcees are required to submit a Judgment of Divorce;
- Widows are to submit the Death Certificate of his/her deceased spouse.

Step 2: Notarization and authentication in US of documents required for marriage registration in Vietnam:

 All file of required documents in US for marriage registration in Vietnam are notarized by the Notary Public or equivalent public authorities (Registrar or Court”s Clerk for document No.3) and authenticated by the State Level’s Secretary of State before legalization by Vietnamese Embassy or Consulate.

Step 3: Legalization of documents in US for marriage registration in Vietnam:

 A non-Vietnamese citizen may submit in person or by mail all file of required documents in US for marriage registration in Vietnam being notarized and authenticated to the Consulate of Viet Nam in New York or to the Embassy of Vietnam in Washington, DC for the authentication/legalization of the papers required before taking them to Vietnam for subsequent procedures.
