Detail list of goods prohibited from import into Vietnam

 Detail list of goods prohibited from import into Vietnam takes effective from 20 February 2014 in connection with Appendix I of Decree 187/2013/ND-CP dated 20 November 2013 of the Government of Vietnam includes:

1. Weapons, ammunition and explosive materials (except industrial explosives), military technical equipment the import into Vietnam is prohibited.

(The Ministry of Defense shall announce this list and record the HS code numbers from the Import and Export Tariff Duty List in connection with Decision No.80/2006/QD-BQP dated 09/5/2006).

2. Assorted firecrackers (except for flares used for marine safely pursuant to guidelines of Ministry of Transport), sky lights and the equipment interfering with the road traffic speech measuring instruments the import into Vietnam is prohibited.

(The Ministry of Police shall guide the implementation of this List, announce this list and record the HS code numbers from the Import and Export Tariff Duty List).

3. Second hand consumer goods the import into Vietnam of which is prohibited, including:

 a) Textiles and garments, shoes and sandals, clothing .
 b) Electronic goods .
 c) Refrigerators.
 d ) Household electrical appliances.
 e ) Medical apparatus.
 f) Furniture and items of interior decoration.
 g ) Household goods comprising porcelain, terracotta and china, glass, metal, resin, rubber, plastics and household good made from other materials.

( Ministry of Trade and Industry shall specific the above line of goods from point a to point g above in more details and record the HS code numbers from the Import and Export Tariff Duty List  in connection with the Appendix I of the Circular No.04/2014/TT-BCT dated 27 Jan 2014).

 h) Second hand information technology products.

( Ministry of Information and Communication shall specific the above line of goods in more details and record the HS code numbers from the Import and Export Tariff Duty List  in connection with Decision No.20/2006/QD-BBCVT dated 30 June 2006 and 11/2007/QD-BBCVT dated 24 May 2007 of Ministry of Posts and Telecommunications).

4. Cultural products, radio prohibited from imports into Vietnam:

 a) Cultural products prohibited from dissemination and circulation in Vietnam,
 b) Postage prohibited from trading, exchange, display or dissemination under the provisions of the Postal Law.
 c) Radio equipment , appliances radio inconsistent with the planning of radio frequency and technical regulations under the relevant provisions of the Law on Radio Frequency.

(Ministry of Information and Communication shall guide implementation, the above line of goods from point a to point c above in more details and record the HS code numbers from the Import and Export Tariff Duty List  in connection with Appendix I of the Circular No.11/2012/TT-BTTTT dated 17 July 2012).

5 . The cultural products prohibited from dissemination and circulation or there is a decision to suspend dissemination and circulation in Vietnam .

( Ministry of Culture, Sports and Tourism shall guide implementation, announce this List in details from point a to c above and record the H S code numbers from the Import and Export Tariff Duty List  in connection with Circular No.48/2006/TT-BVHTT dated 5 May 2006 and 95/2006/TT-BVHTT  of the Ministry of Culture and Information).

6. Vehicles prohibited from import into Vietnam.

 a) Right hand drive motor vehicles (including vehicles in which the right hand drive mechanism has been removed or re-arranged prior to import to Vietnam) except for specialized use right hand drive motor vehicles used in narrowed places such as cranes; canal and drain digging machines; road sweepers, road watering vehicles; rubbish collection vehicles; road surfacing vehicles; passenger vehicle at airport; fork-lift trucks at warehouse and port; concrete pumping vehicles, and caddy vehicles at golf courses.
 b) Automobiles and accessories in which the frame and engine numbers has been erased, amended, renewed.
 c) Motorcycle, specialized vehicles, two wheeled and three wheeled vehicles in which the frame and engine numbers has been erased, amended, renewed.    

(The Ministry of Transportation shall announce this List in details from point a to c above and record the H S code numbers from the Import and Export Tariff Duty List)

7. Second hand materials and transport facilities prohibited from import into Vietnam, comprising:

 a. Motors, frames, tires and tubes, accessories and engines of all types of automobiles, tractors, two wheeled and three wheeled vehicles,
 b. Chasses attached to automobile and tractor engine (including new chasses attached to second hand engine or second hand attached to new engine).
 c. All types of vehicles in which the transmission structure has been changed as compared with the original design; or in which the frame or engine number has been erased.
 d. Ambulances,

 đ. Bicycles
 e. Two and three wheeled motor vehicles,

8 . Chemicals prohibited from import into Vietnam in Appendix III of the Rotterdam Convention.

 ( Ministry of Agriculture and Rural Development , Ministry of Industry and Trade , based on the scope of their assigned responsibilities, shall announces this List in details and record the H S code numbers from the Import and Export Tariff Duty List ) .

9 . Plant protection drugs prohibited from import into Vietnam.

( Ministry of Agriculture and Rural Development shall announces this List in details from point đ, e above and record the H S code numbers from the Import and Export Tariff Duty List ).

10. Scrap and waste, refrigerating equipment using C.F.C prohibited from import into Vietnam

(The Ministry of Natural Resources and Enviroment shall announce this List in details and record the H S code numbers from the Import and Export Tariff Duty List in connection with the Decision 15/2006/QĐ-BTNMT dated 08 September 2006)

11. Products containing asbestos of the group of amphibole prohibited from import into Vietnam.

(The Ministry of Construction shall announce this List in details and record the H S code numbers from the Import and Export Tariff Duty List in connection with the Appendix of Circular No.03/2012/TT-BXD dated 5 September 2012)

12 . Chemicals prohibited from import into Vietnam:

a) Toxic chemicals are specified in Table 1 of the Convention prohibits the development , production , stockpiling , and use of chemical weapons destruction and Appendix 1 promulgated together with Decree No.100/2005/ND-CP dated August 3, 2005 of the Government on the implementation of the Convention prohibits the development , production , stockpiling , and use of chemical weapons destruction.
b ) Chemicals on the list of prohibited chemicals specified in Appendix III  of Decree No.108/2008/ND-CP dated October 7, 2008 of the Government detailing and guiding the implementation of some the Law on Chemicals.

Notes:
1. Goods prohibited from import into Vietnam comply with the provisions in the current legislation and the list of banned imports of goods specified in Appendix I attached to the above-mentioned Decree 187/2013/ND-CP.

2. The permission to import the good from the list of goods prohibited from import into Vietnam specified in Appendix I attached to this Decree is decided by the Prime Minister, except for goods imported for scientific research and humanitarian aid by the Ministry of Industry and Trade issued import permits. Paragraph 3 of Article 3 of Circular 04/2014/TT-BCT provides guidance on procedure of import licensing for scientific research and humanitarian aid as follows :

a) For goods imported for scientific research: Organization of scientific research, traders wish to import the product for research and development (hereinafter referred to as organizations) to send 1 ( a ) the documents by post to the Ministry of Industry and Trade (export Department), address : No. 54 Hai Ba Trung Street , Hoan Kiem District , Hanoi, the dossier includes :
- Decision on the establishment, investment certificate or certificate of business registration, certificate of registration of business : 1 (a) copy , stamped and certified true copy of the organization.
- A written request of the importer to declare the specific organization names, HS code , quantity, purpose and use of each item confirmation , guarantee the authenticity of the contents of this : 1 (a) originals.
- Report on the implementation of the license previously granted (except the first imported case ): 1 (a) original .
Within 7 (seven) working days from the date of receipt of a complete application, as prescribed, to the Ministry of Industry and Trade issued import permits for the organization. In case of no import licensing, the Ministry of Industry and Trade and a written reply stating the reason .

b ) For goods and humanitarian aid: the Ministry of Industry and Trade consider and resolve on the basis of a written request of the competent authority to declare specific names, student numbers, quantity, intended use each item, committed authenticity of the content .
Within 7 (seven) working days from the date of receipt of a complete application, as prescribed, to the Ministry of Industry and Trade has written replies. In case of refusal , the Ministry of Industry and Trade and a written reply stating the reason.
