Divorce is the termination of marriage by court judgment at the request of the wife or husband or spouses, canceling the liability and responsibility of marriage and other civil constraints. The court is the sole authority being responsible for ruling terminating the marriage of the spouses.

1. An divorce petition in Vietnam
Divorce petition in Vietnam include:
+ Divorce petition form.
+ A copy of ID card (passport); Copy of family book.
+ The marriage certificate (original copy or legalized copy if marriage registration in foreign country).
+ A copy of the birth certificate (if there are children).
+ A copy of the documents on the ownership of assets (if any property division).
+ If the spouses married in Vietnam, then one party exit to abroad(not find address, the certificate of the local government on such party were exit abroad and removed its name in family book is required.
+ Confirmation of marriage registration has been annotated (recorded) in records for civil status matters if the spouses registered their marriage under foreign laws.

2. The duration of the trial:
From 3 to 6 months from the date of acceptance of the case.

3. Jurisdiction:
 District Court where the defendant resides

4.Divorce procedure in case of the spouses missing:
 The wife or husband may request the Court to declare the husband or his wife missing and request the court for a divorce.

    Hi I saw your website advice about divorce without consent if one party submits petition the other spouse is missing. If the other spouse is not actually missing, but is a foreigner, can he petition to the court to restore the marriage? This is for claiming matrimonial assets that were hijacked or stolen by the party initiating the divorce.

    I need help finding out some information on a divorce. I married to a Vietnamese girl in 2016. She disappeared and supposedly requested and got a divorce from me in 2018. I need to know if it was done and accepted. I have no idea on anything but she disappeared and supposedly did it. If she did how do I get a copy of the final divorce paper saying it”s officaially over (the marriage). She has not contacted or tried anything else but say she did and disappeared. Can you help with the information? Or steps to get answers to this. Thank you
