Application files, order and procedures for granting a license of eligibility for restricted chemical trading in Vietnam

1. A application files for granting a license of eligibility for restricted chemical trading in Vietnam

a / A written request for granting a license of eligibility for trading in chemicals in standard form set by the Ministry of Industry and Trade;
b / A copy of the business registration certificate or cooperative registration certificate or business household registration certificate;
c / A written declaration list of each business location;
d / A copy of the decision approving or document certifying the documents related to the protection of the environment as prescribed by law promulgated by competent state management agencies;
e / A copy of the design examination and approval certificate and the fire prevention and fighting document of the competent agency for each chemical storehouse subject to the fire prevention and fighting design and approval;
A written record on the fire prevention and fighting safety inspection or the competent agency”s document evidencing that the fire prevention and fighting safety conditions for each chemical storehouse are not subject to compulsory To approve the design on fire prevention and fighting;
e) The general drawing of the site system of each business location, the contents of the drawings must ensure the information on the location of the warehouse, chemical storage area, area and road to the chemical storage area; Copies of papers evidencing the using right of  land for warehouse construction or the warehouse renting contract, for cases of renting warehouse or contracts or agreements on purchase and sale of chemicals in case of use of warehouse of organizations” individuals buying or selling chemicals;
g / The list of technical equipment, labor protection equipment and safety of each chemical trading place;
h / Copies of intermediate or higher degrees in chemical specialty of persons in charge of chemical safety;
i) Copies of dossiers on chemical safety training are prescribed as follows:
 Chemical safety training profiles include:
  a / Training contents;
  b) List of trainees with information: Full name, date of birth, title, position of work, signature of certification of training;
  c / Information on trainers, including: Full name, date of birth, educational level, training and working experience, accompanied by supporting documents;
  d / Contents and results of inspection and training of chemical safety;
  e) Decision on the recognition of the results of the inspection of chemical safety training by applicant.

j / Chemical safety sheets of hazardous chemicals in business establishments as stipulated. Construction of chemical safety data sheets:
 1. Organizations and individuals that produce and/or import hazardous chemicals defined in Point 1, Article 24 of Decree No.113/2017/ND-CP, before putting chemicals into use or circulation in the market, must formulate the Chemical Safety Sheet includes the information as guided in Annex 9 of Circular 32/2017/BCT and is responsible before law for the contents of the Chemical Safety Sheet.

 2. Organizations and individuals must keep a Chemical Safety Sheet for all hazardous chemicals in their premises and ensure that all persons involved in hazardous chemicals are provided with a Chemical Safety Sheet of such hazardous chemicals.

g / Written explanation of the plan on restricted chemicals trading the applicant for granting a license of  eligibility for restricted chemical trading.

2. The order and procedures for appraisal and granting of license of  eligibility for restricted chemical trading in Vietnam

a / Applicants requesting the granting of license of eligibility for restricted chemical trading in Vietnam shall make a application files by mail or sent directly or through an online public-service system to the Ministry of Industry and Trade to process granting license of eligibility for restricted chemical trading in Vietnam;
b / If the application files are incomplete and invalid, within 3 working days after receiving the application files, the Ministry of Industry and Trade of Vietnam shall notify the applicants to supplement or complete the dossier. The time limit for completing dossiers shall not be counted into the time of grant of license specified at Point c of this Clause;
c / Within 16 working days after receiving a complete and valid application files specified in Clauses 1 and 2 of this Article, Ministry of Industry and Trade of Vietnam shall have to consider, evaluate and grant a license of eligibility for restricted chemical trading in Vietnam for applicants. In case of refusal to grant license, Ministry of Industry and Trade of Vietnam must reply in writing, clearly stating the reasons therefor
