Medical license in Vietnam for foreigners and overseas Vietnamese

1. Conditions for issuance of medical license in Vietnam for foreigners and overseas Vietnamese.

1.1. Having one of the following degrees or certificates in conformity with the form of medical practice:
a) Medical professional degrees granted or recognized in Vietnam;
b) Certificate of being a physician;
c) A certificate of being a person who has a traditional medicine or a method of treating a disease.

1.2. Having a written certification of the practice process, except for the case of a physician, a person who has a traditional remedy or has a traditional method of treatment.

1.3. Having a certificate of health for medical practice.

1.4. Not being in the case of being banned from medical practice or doing jobs related to medical or pharmaceutical expertise according to court judgments or decisions; being prosecuted for penal liability; are in the time of serving a criminal sentence, a court”s criminal decision or a decision on application of administrative handling measures, and consignment to an educational institution or medical treatment establishment; are in the period of being disciplined in the form of warning or more related to professional medical examination; loss or limitation of civil act capacity.

1.5. Satisfy the requirements for language use in medical examination and treatment specified in Article 23 of the Law on Medical Examination and Treatment

1.6. Having a criminal record certified by a competent authority of the host country (applicable to cases not subject to a work permit).

1.7. Having a work permit issued by a competent state agency in Vietnam in accordance with the labor law.

2. Requirements on language use in medical examination and treatment in Vietnam of foreigners and overseas Vietnamese

2.1. Certificate of proficiency in Vietnamese for foreigners who register to use Vietnamese for medical examination and treatment.

2.2. In case an applicant for medical license does not have a certificate of proficiency in Vietnamese, an interpreter must be available to translate from his/her registered language into Vietnamese.

2.3. In case an applicant for medical license registers to use a language other than his/her native language for medical examination and treatment, he/she must have a certificate of proficiency in such language and must be accompanied by a translator to translate from such language into Vietnamese.

2.4. For foreigners who register to use a language other than their native language for medical examination and treatment:
- Certificate of proficiency in the language that the practitioner registers to use as prescribed in Article 17 of Decree 109/2016/ND-CP for medical examination;
- A certificate of translation qualification of the translator that the practitioner registers to use for medical examination and treatment as prescribed in Article 18
18 Decree 109/2016/ND-CP and the labor contract of the interpreter with the medical examination and treatment facility where the practitioner works;

3. Requirements for certification of practice period:

Before being granted a medical license, a person with medical degrees granted or recognized in Vietnam must have practiced at the following medical examination and treatment establishments:
a) 18 months of practice at a hospital, research with a hospital bed (hereinafter referred to as a hospital) for doctors;
b) 12 months of hospital practice for physicians;
c) 09 months of practice at a hospital with an obstetrics department or at a maternity home for student households.
d) 09 months of practice at medical examination and treatment establishments for nurses and technicians.

4. Application file for issuance of a medical license in Vietnam for foreigners and overseas Vietnamese:

4.1. An application form for a midical license, made according to Form 04, Appendix I issued together with Decree 109/2016/ND-CP.

4.2. A valid copy of a medical professional degrees suitable for the practice subjects specified in Article 17 of the Law on Medical Examination and Treatment.

4.3. Certificate of practice.

4.4. In case of practice in Vietnam, follow the Form 02, Appendix I issued together with Decree 109/2016/ND-CP; b) In case of practice at overseas medical examination and treatment establishments, the written certification the practice process of the competent person of that establishment must ensure the following contents: Full name of the practitioner; date of birth; residential address; passport number (issue date, place of issue); professional degrees; Graduation year; practice place; practice time; comment on the professional competence and professional ethics of that practitioner.

4.5. A valid copy of the work permit issued by a competent Vietnamese state agency in charge of labor.

4.6. A valid copy of one of the following documents:

4.6.1. Certificate of proficiency in Vietnamese, for foreigners who register to use Vietnamese for medical examination and treatment;
4.6.2. The interpreter”s certificate of translation qualification in accordance with the language that the practitioner registers to use for medical examination and treatment and the interpreter”s labor contract with the medical examination and treatment establishment where the practitioner works;
4.6.3. For foreigners who register to use a language other than their native language for medical examination and treatment: - Certificate of proficiency in the language that the practitioner has registered to use as prescribed in Article 17 of Decree No. Decree 109/2016/ND-CP for medical examination and treatment; - Certificate of proficiency in interpreting of the language interpreter that the practitioner registers to use for medical examination and treatment as prescribed in Article 18 of Decree 109/2016/ND-CP and the labor contract of the applicant. interpreters with medical examination and treatment establishments where such practitioners work.

4.7. A certificate of health for medical  examination and treatment, issued by a medical examination and treatment establishment that meets the requirements as prescribed by the Minister of Health, or a certificate of health issued by a foreign medical examination and treatment establishment, but the time for the issuance of the health certificate is not more than 12 months from the date of submitting the application for the medical license.

4.8. Criminal record (applicable to cases not subject to work permit issuance).

4.9. Two 04 cm x 06 cm color photos taken on a white background within a period of no more than 06 months, up to the date of application.
(Authenticated copy of professional degrees; Certificate of practice; Certified copy of certificate of proficiency in Vietnamese issued by a foreign organization must be consular legalized and translated into Vietnamese, the translation must be certified according to the provisions of Vietnamese law).

5. Procedures for issuance of medical license in Vietnam to foreigners and overseas Vietnamese.

5.1. The applicant for medical license shall send the application files to the Ministry of Health of Vietnam;

5.2. The Ministry of Health of Vietnam will receives and sends the application receipt to the applicant.

5.3. Within 20 days from the date on which the application is received, the Ministry of Health of Vietnam will consider and appraise the application and issue a detailed appraisal minutes:
- If the application is valid, within 10 working days from the date of the appraisal record, the application-receiving agency shall issue a medical license to the applicant.
- In case the application is not valid, within 05 working days from the date of the appraisal record, the application-receiving agency must send a written notice to the applicant. the applicant for the medical license to complete the dossier. The written notice must specify the documents that need to be supplemented and the contents that need to be amended.
- In case of ineligibility to issue a practicing certificate, the Ministry of Health of Vietnam will reply in writing and state the reason.
