An employer must, at least seven (7) business days prior to foreign worker commencing work, request the Vietnam Department of Labour in the locality where the foreign worker will work on a regular basis to confirm that they are exempted from work permits.

An application file requesting confirmation shall comprise:

 (a) Request for confirmation that the foreigners are exempted from work permits in Form 10 (Download);

 (b) Spreadsheet list of foreigners stating their names, ages, nationalities, passport numbers, dates of commencing and finishing work, and their working positions;

 (c) Data proving that the foreigners fall into the category exempted from work permits.

 Data proving that a foreigner is in the category exempt from work permit must be provided in one original or in one copy; if it is in a foreign language it is not required to be consularized but must be translated into Vietnamese and certified in accordance with the law of Vietnam.

 The Department of Labour shall provide the employer with a letter of confirmation within three (3) business days after receipt of a complete application file. In a case of refusal, the Department shall provide a written response specifying its reasons.
