State inspection of the quality of animal feed imported into Vietnam

The Department of Livestock Production, Ministry of Agriculture and Rural Development of Vietnam, has issued Official Letter No. 536/CN-TACN dated July 22, 2022 to the General Department of Vietnam Customs. Pursuant to Point a, Clause 9, Article 1 of Decree 46/2022/ND-CP, some regulations on state inspection of quality of imported animal feed are amended in Clause 4, Article 18 of Decree No. 13/2020/ND CP as follows:

“d) For animal feed specified at Point b, Clause 2 of this Article: the entity shall  complete customs declaration procedures and select a designated conformity certification organization on animal feeds to assess the conformity of the shipment. If the shipment conforms to the registerred applicable technical regulations and standards, the conformity certification organization shall issue a Certificate of conformity for the shipment so as for the entity to submit to the customs authority for customs clearance, and at the same time notify the inspection authority.

In case the shipment has unconformable inspection results, the conformity certification organization shall notify the inspection authority for handling in accordance with law.”.

Thus, from July 13, 2022, the entity importing animal feed specified at Point b, Clause 2, Article 18 of Decree No. 13/2020/ND-CP shall submit a Certificate of Conformity for the shipment according to above regulations (instead of submitting the "Notice of results of state inspection of imported goods” quality" issued by the inspection authority according to the previous regulations) to the customs authority for customs clearance. However, the current National Public Service system cannot be updated immediately to meet the electronic file transfer of the Certificate of Conformity to the customs authority. Therefore, the Department of Livestock Production shall notify the General Department of Customs to guide the border-gate Customs to receive the Certificate of Conformity in accordance with the appropriate method to carry out customs clearance procedures for the imported feed shipment as prescribed in Decree No. 46/2022/ND-CP.
