Conditions for import of second hand machinery and equipment into Vietnam as per Circular No.20/2014/TT-BKHCN dated 15 January 2014 of the Ministry of Science and Technology of Vietnam:

Conditions for import of second hand machinery and equipment into Vietnam

1. Terms and conditions for import of second hand machinery and equipment into Vietnam

 Second hand machinery and equipment is permitted for import into Vietnam if it meets the following conditions:

 a) It has a used period which is not more than 05 years;
 b) It has its remaining quality compared with the original one is from 80% or more.
 c) Second hand machinery and equipment is not subject prohibition list for import into Vietnam according to Decree No. 187/2013/ND-CP dated 20 November 2013, Circular No.04/2014/TT-BCT dated 27 Jan 2014 and Circular No.11/2012/TT-BTTTT dated 17 July 2012.
 d) It is not subject to conditions for import of some special following cases:

  i. Second hand machinery and equipment is permitted for import into Vietnam if it has used period which is not more than 03 years and the remaining quality compared with the original one is 80% or more, namely:

  o Machinery and equipment for agricultural production.
  o Machinery and equipment used in beer, wine, alcoholic beverages and non-alcoholic.
  o Machinery and equipment industry postal mail sorting equipment, parcels; envelope folding cage; envelope production machine; conveyor equipment.

 ii. Second hand machinery and equipment is permitted for import into Vietnam if it has used period which does not exceed 07 years and the remaining quality compared with original one is 80% or more, namely:

  o Machinery and equipment in the field of geology and mineral.
  o Machinery and equipment for shipbuilding, ship repair.
  o Machinery and equipment for the construction of offshore platform.
  o Machinery and equipment for construction of transportation infrastructure.
  o Machinery and equipment for production in the printing industry: film recorder, recorder zinc, extruder, printer trimming knife (cut) paper, binding machines (closed steel or sewing), folding machine books, on the cover of the book.

 iii. Second hand machinery and equipment are permitted for import into Vietnam if it has used period which does not exceed 10 years and the remaining quality compared with the original one is 80% or more, includes:

  o Marine propulsion engines used for offshore fishing boats.
  o Integrated Machine horsemen serving in the production printing industry.

 iv. The second hand machinery and equipment are permitted for import into Vietnam if it has used period which is not more than 15 years and the remaining quality compared with the original one is 80% or more, includes: offset printing machine, gravure printing machine, flexor printing

2. Procedures for the import of second hand machinery and equipment into Vietnam

 Enterprises implement import procedures at customs offices of Vietnam where goods imported. Besides the importing dossiers as prescribed by law, enterprise must send to the custom office the following documents:

 a) Technical documentation showing the year of manufacture of imported machinery and equipment;
 b) Certificate of quality assessment issued by appointed assessment organizations (If assessment certificates held by foreign expertise, enterprises must enclose copy of certificate of lawful management system accordance with international standards ISO / IEC 17020 current version of the assessment organization).

However, this Circular shall stop going in force from 1 Sept 2014 in accordance with Decision 2279/QĐ-BKHCN dated 28 August 2014 of Ministry of Science Technology and Enviroment.
