List of goods not permitted for implementation of the export, import and distribution rights of FDI enterprise in Vietnam

 Ministry of Industry and Trade issued Circular 34/2013/TT-BCT dated 24 Dec 2013 of Ministry of Industry and Trade announcing the schedule for implementation of commodity trading activities and activities directly related to the purchase and sale of goods of FDI enterprises in Vietnam.

List of goods not permitted for implementation of the export, import and distribution rights of FDI enterprise in Vietnam

 Implementation of the export, import and distribution rights of foreign capital enterprises in Vietnam:

1. Foreign capital enterprises in Vietnam is permitted to implement the export right to goods not on the list of goods specified in Appendix 01 includes:

 1.1. Crude oil,
 1.2. Condensate
 1.3. Others.

2. Foreign capital enterprises in Vietnam is permitted to implement the import right to goods not on the list of goods specified in Appendix 02 includes:

 2.1. Cigars, double-filter cigars, cheroots and cigarettes processed from tobacco leaf or replacement tobacco leaf.
 2.2. Processed tobacco leaf and other processed replacement tobacco leaf; "pure" tobacco and "reconstituted" tobacco; tobacco extract and tobacco essence.
 2.3. Petroleum oils and oils obtained from bituminous minerals (other than crude) and preparations not elsewhere specified or included, containing by weight 70 % or more of petroleum oils or of oils obtained from bituminous minerals, these oils being the basic constituents of the preparations, other than those containing biodiesel and other than waste oils:
 2.4. Newspapers, journals and periodicals, whether or not illustrated or containing advertising material.
 2.5. Discs, tapes, and other media for the recording of sound or of other phenomena, including matrices and masters for the production of discs…
 2.6. Other aircraft (for example, helicopters, airplanes); spacecraft (including satellites) and the trajectory aircraft and means of propulsion for spacecraft.
 2.7. Parts of goods of heading 88.01 or 88.02.

3. Foreign capital enterprises in Vietnam is permitted to implement the distribution rights to goods not on the list of goods specified in Appendix 03 includes:

 3.1. Rice
 3.2. Cane or beet sugar.
 3.3. Cigarettes and cigars
 3.4. Crude oil and processed oil
 3.5. Pharmacy:  Consist of medicine items prescribed in Clause 2, Article 2, Law on Pharmacy No. 34/2005/QH11
 3.6. Explosives
 3.7. Books, newspapers and magazines
 3.8. Precious metals and gemstones
 3.9. Items recorded in any material form

 - Appendix 3: List of goods not permitted for implementation of distribution rights

This Circular will take effect from 05 February 2014 replacing Decision No.10/2007/QD-BTM dated 21 May 2007of the Ministry of Commerce announcing the schedule for implementation of trading activities and distribution of goods.
