From 25th May 2014, workers being domestic servants in Vietnam must sign the labour contract in accordance with the Decree 27/2014/NĐ-CP dated 07th April 2014 of Vietnamese Government.

Labour contract for workers being domestic servants in Vietnam

A labour contract for workers being domestic servants in Vietnam must contain the following main particulars:

1. Name and address of the enterprise or of the employer”s lawful representative;
2. Full name, date of birth, sex, residential address, and number of identity card or other legal document of the employee;
3. Job description and workplace;
4. Term of the labour contract;
5. Wage rate, method of and time of payment of wages, allowances and other additional payments;
6. Regime for wage increases and promotion;
7. Working hours and holidays;
8. Personal protective equipment of the employee;
9. Social insurance and health insurance;
10. Training and skill improvement;
11. Conditions of the worker regarding meals and accommodation (if any).
12. Travelling expenses to return home on termination of the labour contract at the agreed time.
13. Time off and the amount of expenses by way of support for the worker to undertake academic studies or trade training (if any);
14. Liability to pay compensation as a result of causing loss and damage to equipment or as a result of other conduct causing loss and damage to assets of the employer.
15. Conduct of both parties which is strictly prohibited
