Vietnamese attorney at law

1.Definition of Vietnamese attorney at law

Vietnamese attorney at law is a person who satisfies all the standards and conditions to practise in accordance with the provisions of  Law on lawyers  of Vietnam and who provides legal services at the request of  clients

2. Standards for Vietnamese attorney at law

A Vietnamese citizen who is loyal to the Fatherland, who complies with the constitution and laws, is of good morals, has a bachelor”s degree in law, has completed a legal professional training course and the probation period for legal practice, and is in good health sufficient to practise law, may become a Vietnamese attorney at law.

3. Conditions for practising law in Vietnam

Any person who satisfies the standards stipulated in Clause 2 above and who wishes to practise law in Vietnam must have a legal practising certificate issued by the Justice Ministry of Vietnam and be admitted to a bar association in Vietnam.

4. Legal professional training

-  Any person who has a bachelor”s degree in law shall be permitted to register to attend a legal professional training course at a legal professional training establishment in Vietnam.
- The duration of a legal professional training course shall be six (6) months.

5. Legal practice probation

-  A person who has a certificate of graduation from a legal professional training course shall be permitted to undergo legal practice probation at a legal practising organization in Vietnam.
- The duration of legal practice probation shall be eighteen (18) months except in a case of reduction of duration as stipulated in clause 2 or 3 of article 16 of Law on Lawyers. The date of commencement of legal practice probation shall be the date of registration of probation at a bar association in Vietnam.

6.Inspection of results of legal practice probation

- The Ministry of Justice shall co-ordinate with the National Lawyers” Association to inspect the results of legal practice probation.
- The inspection of results of legal practice probation shall be made by the Council for Inspection of Results of Legal Practice Probation, such Council to comprise a representative of the leaders of the Ministry of Justice as chairman, a representative of the leaders of the National Lawyers” Association, and a number of lawyers as members. The Minister of Justice shall issue a decision on the list of members of the Council.
- The Council for Inspection of Results of Legal Practice Probation shall operate in accordance with the rules on legal practice probation.
- When a person satisfies the requirements of inspection of results of legal practice probation, the Council for Inspection of Results of Legal Practice Probation shall propose to the Minister of Justice that the latter issue a certificate of inspection of results of legal practice probation.

7.Legal services of Vietnamese attorney at law.

Legal services of Vietnamese attorney at law shall include participation in legal proceedings, legal consultancy, representation of clients other than in legal proceedings and provision of other legal services.

Vietnamese attorney at law is a Vietnamese lawyer, Vietnamese Barrister, Vietnamese solicitors, Vietnamese counselor, Vietnamese advocate.
